Jeurys Familia‘s wife Bianca Rivas, has asked the authorities that the simple assault charges against her husband be dropped, the prosecutor told Jim Baumbach of Newsday.

During Familia’s first court appearance on November 10, the judge stated that the prosecutors can still proceed with the case even if the victim wants to drop the charges.

Additionally, MLB is investigating the matter irregardless of how Fort Lee law officials prosecute their case.

The prosecutor in the case will decide whether or not to proceed with the case before Dec. 15, which is when Familia is due in court again. He is being represented by Jay Reisinger, who represented Aroldis Chapman last offseason on his domestic violence charges.

According to a new report in the New York Post, Mets closer Jeurys Familia was “going crazy” and “drunk” the night he was arrested in New Jersey on a domestic violence charge, according to his wife.

According to what Familia’s wife Bianca told the police and also in a 911 call, Familia caused her “bodily injury” which was in the police report. The report also cited a scratch on the chest and a bruise on the right cheek of Bianca, whose name was originally redacted.

“My husband had a little bit of alcohol and he’s going crazy,” Bianca also says on the emergency call to Fort Lee police, obtained by NJ.com. “Your husband is drinking and you’re in a dispute with him?” the dispatcher asked.

This keeps getting uglier for Familia, who pleaded not guilty last week in a court appearance. The longer this goes on without an apology and some remorse from Familia, the longer that MLB suspension keeps getting regardless of what the legal outcome is.

New York Mets reliever Jeurys Familia was in court today for the first time since being arrested on October 31 for alleged domestic violence. He was in Fort Lee Municipal Court this morning in New Jersey.

Through his attorney, Familia pleads not guilty according to Jim Baumbach of Newsday. The next hearing in the case will be on December 15. The judge ordered that the name of the victim can’t be reported.

MLB commissioner Rob Manfred said on Wednesday that they will let the legal process play out before finishing their own investigation and deciding on a possible suspension for Familia.

Familia, 27, lead major league baseball with 51 saves this past season which also set a new single season franchise record. He has led MLB with 154 regular season appearances over the past two seasons.
